New Modifications to the General Rules of Foreign Trade: Implications for Companies in Mexico

On October 14, 2024, the Second Resolution of Amendments to the General Foreign Trade Rules for 2024 and its Annexes 1, 2, 5, and 24 were published in the Federal Official Gazette (DOF). These modifications introduce significant changes that impact companies operating under the certification scheme, particularly in the areas of subcontracting and inventory control.
 
Some of the most significant changes affect companies that subcontract specialized services. These companies must now ensure their providers maintain a valid registration in the Registry of Specialized Service Providers (REPSE). Additionally, IMMEX (Manufacturing, Maquiladora, and Export Services Industry Program) companies must now return at least 80% of the total value of temporary imports, up from the previous 60%.
 
Another important change is that if companies deny access to AGACE personnel during initial inspection visits, it may result in an automatic rejection. Additionally, companies must maintain strict inventory control and provide online access to customs authorities.
